Terms of Service

1. Service Description

cutlabAI is an AI-powered photo transformation application. The App allows you to upload photos, select artistic styles or provide text prompts, and generate AI-transformed images and videos. The App uses third-party AI models to process your content.

2. Eligibility

You must be at least 16 years old to use the App (in accordance with EU regulations). By using the App, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Account & Security

You sign in using your Google or Apple account via Clerk authentication. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@cutlabai.pl if you suspect unauthorized access to your account.

4. Content Ownership & License

• Your Input: You retain all rights to the photos and content you upload to the App.
• Generated Output: You receive a non-exclusive, worldwide license to use AI-generated content created through the App for personal and commercial purposes, subject to these Terms.
• Our License: By uploading content, you grant us a limited, non-exclusive, worldwide license to process, transform, and store your content solely for the purpose of providing and improving the App's services. We do not claim ownership of your content.
• Shared Outputs: AI-generated content may not be unique. Other users providing similar inputs may receive similar outputs. We do not guarantee exclusivity of generated content.

5. Prohibited Use

You agree not to use the App to:

• Generate content depicting child sexual abuse or exploitation.
• Create non-consensual intimate imagery of real people.
• Generate content that promotes violence, terrorism, or hatred.
• Impersonate real individuals without their consent.
• Circumvent safety systems or content filters.
• Use the service to violate any applicable laws or third-party rights.
• Reverse engineer, decompile, or attempt to extract the source code of the App.

Violation of these restrictions may result in immediate account termination without refund.

6. Subscriptions & Credits

• The App operates on a credit-based system. Certain features and styles require credits or a premium subscription.
• Subscriptions are billed through the Apple App Store and auto-renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds for App Store purchases are handled by Apple in accordance with their refund policy. Contact Apple at reportaproblem.apple.com or email us at support@cutlabai.pl for assistance.
• We reserve the right to modify pricing, credit amounts, and subscription features. Existing subscribers will be notified of material changes in advance.

7. AI-Generated Content Disclaimer

AI-generated content is produced by automated systems and may contain inaccuracies, artifacts, or unexpected results. We do not guarantee the quality, accuracy, or suitability of generated content for any particular purpose. You are solely responsible for reviewing and using generated content appropriately.

8. Intellectual Property

All rights to the App's software, design, branding, AI models, and trademarks belong to Antoni Ciechanowicz DGC E-COM or our licensors. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the App as intended.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you acknowledge that you have read and understood our Privacy Policy.

10. Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the App, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App or via email.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Gdynia, Poland. If you are a consumer residing in the EU, you also retain the right to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory consumer rights under applicable law.
